TERMS & CONDITIONS
Online Running Coaching
These Terms & Conditions govern the coaching services provided by COUNTRYFIT LIMITED ("the Coach") to the client ("the Client").
By purchasing coaching services, the Client agrees to these Terms & Conditions.
1. Coaching Services
Coaching includes a personalised running programme, ongoing support, training plan adjustments and communication as outlined in the coaching package purchased.
Services may vary depending on the coaching package selected.
2. Payments
Coaching fees are payable in advance.
Payments are collected monthly unless otherwise agreed in writing.
Failure to make payment may result in coaching services being paused or terminated until payment is received.
3. Minimum Commitment
There is no minimum contract unless otherwise stated.
Coaching continues on a rolling monthly basis until cancelled.
4. Cancellation
Either the Client or the Coach may terminate coaching by providing one (1) calendar month's written notice.
Notice must be given by email.
Coaching will continue during the notice period unless otherwise agreed.
Fees paid during the notice period are non-refundable.
5. Refunds
Due to the personalised nature of coaching services:
Monthly coaching fees are non-refundable once the coaching month has commenced.
No refunds will be given for partially completed months.
Missed coaching calls, messages or unused coaching time cannot be carried forward unless agreed by the Coach.
Nothing in this clause affects the Client's statutory rights.
6. Missed Sessions
If the coaching package includes video or phone calls:
The Client must provide at least 24 hours' notice to rearrange.
Missed appointments without sufficient notice may be forfeited.
7. Communication
The Coach will aim to respond to messages within 48 hours during normal business days.
Messages received during weekends, bank holidays or periods of annual leave may take longer.
Coaching does not include 24/7 support.
8. Programme Changes
Training plans are based on the information provided by the Client.
The Client agrees to notify the Coach promptly of:
Injury
Illness
Pregnancy
Medical advice received
Significant life events affecting training
Failure to provide accurate information may affect the suitability of coaching recommendations.
9. Client Responsibilities
The Client agrees to:
Complete sessions safely.
Follow medical advice where applicable.
Exercise within their own ability.
Inform the Coach of any concerns before completing training sessions.
The Client remains responsible for deciding whether to undertake each session.
10. Results
The Coach cannot guarantee:
Personal bests
Race results
Weight loss
Injury prevention
Fitness improvements
Results depend upon many factors outside the Coach's control.
11. Coach's Right to Terminate
The Coach reserves the right to terminate coaching immediately where the Client:
Behaves abusively or disrespectfully.
Fails to make payment.
Provides false or misleading information.
Repeatedly fails to engage with coaching.
Requests services outside the Coach's professional scope.
Where coaching is terminated by the Coach for reasons other than breach of these Terms, any prepaid fees covering future coaching not yet provided will be refunded on a pro-rata basis.
12. Annual Leave
The Coach may take annual leave during the year.
Reasonable notice will be given wherever possible.
Training programmes will continue where appropriate.
13. Intellectual Property
All training plans, videos, documents, resources and coaching materials remain the property of the Coach.
Clients may not reproduce, distribute, sell or share these materials without written permission. Clients found in breach of this may result in legal action against them.
14. Privacy
Personal information will be handled in accordance with the Coach's Privacy Policy and applicable UK data protection legislation.
15. Force Majeure
The Coach shall not be liable for delays or failure to perform services caused by circumstances beyond reasonable control, including but not limited to illness, natural disasters, internet outages, power failures or government restrictions.
16. Changes to These Terms
The Coach may update these Terms & Conditions from time to time.
Clients will receive reasonable notice of any material changes.
Continued use of the coaching service after such notice constitutes acceptance of the updated Terms.
17. Governing Law
These Terms & Conditions are governed by the laws of England and Wales.
Any dispute shall be subject to the exclusive jurisdiction of the courts of England and Wales, except where mandatory consumer protection laws in the Client's country of residence provide otherwise.
